Subject: facilities provided by erstwhile GTB management to Core Healthcare Ltd from branch of EGTB at CG Road , Ahmedabad

Kindly refer to my earlier communication as per above reference for which the bank has not furnished detailed satisfactory reply backed by documentary evidences till date.

I have reason to believe that charge was already created by Core Health care much prior to August 1998 and hence, there was no reason for Jatin Jalunhwala to create a fresh charge subsequently in 1998 on the assets of Rupmangalam, Flovin, Dhanyushya. More so, when the charge created prior on assets of Core Health care was satisfied/paid in first quarter 1999 and replaced by another charge of Rs 12.5 crores on assets of RIPL, FPPL and DFL and Core health care in March 1999 .

This shows that this was done in collusion with the concerned officers as well as the management of GTB to let Core Health care dilute the security or let the responsible directors of Core Health care and Dhanyushaya Financial to avoid facing huge liabilities.

I therefore call upon Chairman and Managing Director, Executive Director and General Managers and Regional Director and Branch Manager of CG Road branch and Vidya Rudra of Oriental Bank of Commerce
to furnish a copy of Notarized written affidavit before magistrate/judge either confirming that the charge was created prior to August 1998 by GTB management or denying that the charge was not created prior to August 1998 on assets of Core Healthcare.

A notarized copy of written affidavit before the Magistrate would be furnished to me at my email address latest by 23 rd August 2005 and followed up by dispatch in post to my email address as well as simultaneously to the Home Department of Government of Gujarat at their email address and the Registrar of Gujarat High High Court at their email address that you are fully satisfied wit the conduct of the Chairman & Managing Director of Core Health care as well as Mr. Jatin Jaludhwala and the concerned officers of GTB management. The email address of Home Department of Government of Gujarat is
pshome@gujarat.gov.in. The email address of Gujarat High Court is hcguj@guj.nic.in. Kindly note that when you send email to me , it should be visible to me that you have simultaneously sent copy of email to Home Department and Highcourt of Gujarat.


In case ,all of you remain silent , then it is obvious that all of you confirm collusion with the directors of Core Health care , Jatin Jalundhwala and the concerned management of GTB to allow them to go scot free. By this email you are called upon to clarify your position in form of written affidavit either confirming or denying the charge creation by Core Health care prior to August 1998 and whether you have taken criminal action against them or not.

Kindly note that I have been receiving tacit threat from the persons unknown to me while strongly and aggressively suggesting and advising me to withdraw case pending against GTB and others and they have claimed that they have met OBC management and have been asked by OBC management to meet the undersigned so that I withdraw or settle the case.

I am therefore, constrained to send this letter for my personal safety to prevent any further harassment from the bankers directly or indirectly as in the past - the management of GTB had parted the contents of my private and confidential letter to the management of Core Health care with a view that I am silenced , harassed and subjected to police remand and hence , such tactics, are presumably being employed by the bank directly or indirectly for the reasons best known to you and your management staff in connivance with Core healthcare and its employees and their advocates and their chartered accountants including Mr and Mrs Sushil Handa.

The present issue is over and above to the issues raised in earlier emails addressed to you and I reserve my right to take up other issues from time to time with you and/or authorities.

I look forward to your immediate acknowledgment as well as reply in this connection as part of courtesy as a banker to the citizens of the country.
